Terms and Conditions of Sale and Fixing

Quotation Price
- The “Quotation price” remains open for acceptance for a period of thirty (30) days.
- Once accepted, the “quotation price” is fixed for thirty (30) days unless otherwise specified.

Variation in Quotation Price
Canterbury Roof Tiles reserves the right to vary the estimated price if:
- The roof is not ready for tiling within thirty (30) days of the estimate date.
- The roof is not completed within two (2) months of the date it was ready for tiling.
- Site conditions have changed since the quotation (e.g., landscaping, driveways, or other completed works requiring protection).
- The scope of works has changed after demolition, resulting in additional materials or labor.
- The roof structure has been altered since the quotation (e.g., timber or roof works performed).
The Client shall reimburse Canterbury Roof Tiles for all reasonable costs including but not limited to overheads incurred by Canterbury Roof Tiles for any delays except for delays caused by Canterbury Roof Tiles itself.

Site Preparation - All Jobs
The Builder/Customer agrees to:

Provide:
- A 240V single-phase power outlet or suitable power equipment.
- Access to water for mortar.
- Scaffolding as agreed, fully and safely erected.

Ensure compliance with:
- Statutory authorities, councils, and regulatory bodies.
- All normal and prudent work health and safety practices.
- Ensure rafters are level and flush.
- Ensure driveways are clear of vehicles, if required.
- Remove movable items from site to prevent damage.
If any of the above requirements cannot be met, the customer shall incur a fee.

Provide:

Site Preparation - New Builds and Extensions
The Builder/Customer will:
- Ensure the roof is properly prepared for tile installation.

Complete all carpentry works prior to tiling:
- Including tilt battens, lining boards, fascia, trusses, etc.
- Return fees may apply if not completed.

Complete all plumbing works before tiling:
- Includes valley irons, box gutters, flashings, etc.
- Provide half a cubic meter of bricklayer’s sand at the job site prior to bedding and pointing. Failure to do so will result in additional charges.
- The Client must provide Canterbury Roof Tiles with access to the Site and possession of a sufficient portion of the Site to enable us to properly perform the Works without interference. Canterbury Roof Tiles will be entitled to claim an extension of time and costs incurred as a result of any delay caused due to any interference of the Client or others on Site and/or delay in access to the Site.
If any of the above requirements cannot be met, the customer shall incur a fee.

Terms of Payment
Except as otherwise agreed by Canterbury Roof Tiles in writing, the Client shall pay all invoiced amounts in Australian dollars, without right of set off, within thirty (30) days from the date of Invoice in accordance with and in the manner set out in the quotation.

Account Customers:
Account customers - invoice 100% payable 30 days after materials delivered to site or as agreed via progress payments.

All Other Customers - Re-roof / Extension / New Build:
10% deposit upon acceptance - Materials Ordered
40% payable on day of material depvered to site and/or safety rail installed
30% on day of commencement of Roofing Works
20% upon completion
Repairs:Quotes Under $800 are payable in full on time of acceptance
Over $800.0070% deposit upon acceptance - works completed in full
30% Balance due on completion of works as per quote
All balances are payable within 30 days (account customers) or as agreed (non-account customers).
If the Client fails to pay Canterbury Roof Tiles the full amount stated in the Invoice in accordance with this clause, then Canterbury Roof Tiles will charge interest on the amount paid by the Client at a rate of 2% interest per week.
Canterbury Roof Tiles may enter the Client’s premises, or the premises of any associated entity or agent of the Client where the Goods are located, without liability for trespass or any resulting damage and retake possession of the Goods; and to keep to resell the Goods repossessed under this clause.

Account Customers:

Indemnity Insurance & Limitation of Liability

The customer indemnifies Canterbury Roof Tiles against all claims, costs, or liabilities arising from:
- Customer’s failure to perform obligations.
- Breaches by the customer or agents.
- Weather damage
- Damage to job sites, driveways or footpaths.
- For re-roofing, Canterbury will insure the property for the duration of works. Customers are responsible for their own insurance cover.
- Canterbury accepts no liability for minor cracking in plaster or cornices including cracking of plaster around skylights.
- Claims must be made in writing within 48 hours of job completion.

Canterbury is not liable for damage after completion caused by:
- Anyone walking on the roof.
- Solar or plumbing works.
- Pressure cleaning or other access.
- Any damage not caused directly by Canterbury Roof Tiles.
- Liability protections extend to Canterbury’s employees, agents, and contractors.
- Second opinions or assessments from third parties will not be accepted in lieu of Canterbury's own inspection and records.

The customer indemnifies Canterbury Roof Tiles against all claims, costs, or liabilities arising from:

Additional Charges
Extra charges apply if:
- Site requires excessive carrying distance (more than 9m).
- Actual site conditions differ from plans/specifications.
- Delays occur for any reason. A $300 delivery cancellation fee applies.

Ability to Supply
Work may be delayed due to:
- Tile unavailability.
- Acts of God (e.g., floods, fire, pandemics).
- Industrial action.
- Weather or regulatory delays.
No liability is accepted for delays under such circumstances.

Ownership and Title to Supply
- Materials remain the property of Canterbury Roof Tiles until all sums due and owing by the Client are fully paid.
- Canterbury Roof Tiles can remove all / any materials not yet paid for from the site until final payment.
- Canterbury Roof Tiles reserves the right to make a reasonable charge for storage of the Goods or any component of the Client to be used in manufacture or supply of the Goods, if delivery instructions are not provided by the Client within 14 days of a request by Canterbury Roof Tiles.
- Canterbury is not responsible for site clean-up unless it is a re-roofing job. Canterbury will clean site into a bin that is provided by builder / client and needs to be within close distance of roof - “throwing distance”.

Use of Driveways and Access
Canterbury Roof Tiles is not liable for any damage caused to driveways or access points, whether caused by employees or contractors.

Aluminum Foil Sarking
Canterbury is not responsible for noise caused by aluminum sarking under wind or draft conditions.

Scope of Work
Work may include:
- Processing estimate, preparing internal job sheets.
- Site inspection and access checks.
- Delivery of materials.
- Removal of old tiles (re-roofing only).
- Installation of battens, tiling, bedding, and pointing.
- Clean-up of re-roofing debris.
All work is subject to these Terms and Conditions.

Difficulties in Completion
- If work becomes impractical due to customer actions, Canterbury may demand full payment for completed work within seven (7) days.
- Price increases due to delays will be passed on to the customer.

Cancellation & Termination
- Customer may cancel only with Canterbury’s consent and must pay for work done, including administration, transport, and preparation costs.
- Canterbury may cancel with 7 days’ notice and is not liable for any resulting claims.

Canterbury may terminate if:
- Customer breaches any part of this agreement.
- Customer fails to pay or provide title verification.
- Deposits are non-refundable upon termination
Either party may terminate this Agreement at any time by providing written notice to the other party.
In the event the customer terminates the contract, the customer shall pay Canterbury all outstanding Invoices and for all Goods and/or Services provided to the customer up to the date of cancellation.
In the event Canterbury terminates the contract, the customer shall have no right to make any claim, demand, or commence any legal proceedings against the other party in respect of or arising out of this Agreement.

Force Majeure
Neither party is liable for failure to perform due to unforeseen events such as pandemics, strikes, or natural disasters.

No Agency
The customer enters into the agreement as principal and is responsible for all payments and obligations, even if authorizing another party to act on their behalf.

Warranty
Workmanship Warranty (Canterbury Roof Tiles):
- Two (2) years on tile installation, valleys, sarking, and pointing.
- At Canterbury’s discretion, repairs or replacements will be made.
Exclusions:
- Client opting for minor repair instead of full replacement.
- General wear and tear.
- Ignoring manufacturer specifications.
- Blemishes, fading, salt deposits.
- Natural disasters, pest damage, stepping on tiles.
- Any damage by third parties or contractors.
The above warranty provided by Canterbury will not apply and/or is voided if the customer retains another company to attempt to fix or assess repairs assigned to Canterbury.
Canterbury cannot guarantee any of their work if another company is involved in the works in any way.
Manufacturer Warranty:
Refer to product-specific manufacturer warranties. These can be viewed via manufacturers website, clients will receive the warranty for Canterbury works once works invoice has been paid in full. -
Dispute Resolution
- Disputes must first be raised with Canterbury Roof Tiles and allow Canterbury the opportunity to resolve any disputes.
- All Photo and email records are maintained.
- The client must allow site access for resolution purposes.

Damage to Property
- Canterbury acknowledges risk of accidental damage and will rectify damage if it is proven to be its fault through evidence. Clients must take preventive measures to protect personal property.
- Clients must hold their own insurance for uncovered damage.

Repairs - Special Conditions
Ceiling inspections and photos and/or documentations (insurance claim reports) are required before quotes/repairs can be done and must be witnessed and approved by client hiring Canterbury.
Flat concrete/terracotta tiles watercourse issues are hard to detect. A fee per tile removal plus OH+S services will be charged. Canterbury recommends re-roofing.
Canterbury must be consulted before further repairs or insurance company interventions.
Canterbury offers options but cannot guarantee outcomes of cost-cutting approaches.

Supply Only Materials or Returned Goods
Canterbury Roof Tiles is not under any duty to accept Goods returned by the Client or refund cost of Supply Only Materials to a client.
Definitions
Additional Charges
Additional charges may apply if site requirements are not met (e.g., failure to provide sand, power, or access), if there are delays not caused by Canterbury Roof Tiles, or if the scope of works changes after quotation. These charges cover any loss or extra costs incurred by Canterbury Roof Tiles, which the customer agrees to pay. For example, a $300 delivery cancellation fee applies if transport is cancelled. Such charges may also include loss or damage suffered by Canterbury Roof Tiles and any additional costs incurred.
Builder
The "builder" is responsible for site preparation, including providing power, water, and scaffolding, ensuring compliance with statutory authorities and work health and safety practices, and completing all carpentry and plumbing works prior to tiling. The builder may be the same as the customer and is responsible for ensuring the roof is ready for tile installation and for supplying necessary materials such as bricklayer’s sand. Failure to meet these requirements may result in additional charges.
Cancellation
Cancellation refers to the termination of the agreement. If the client cancels, they must pay for all work done, including administration, transport, and preparation costs. Deposits are non-refundable upon termination. Canterbury Roof Tiles may also cancel with notice and is not liable for any resulting claims. All outstanding invoices and costs for goods/services provided up to the date of cancellation must be paid by the client.
Canterbury
"Canterbury" or "Canterbury Roof Tiles" refers to the business entity operating under the name "Canterbury Roof Tiles," which is operated by Crown Roofing and Building Sales Pty Ltd - ABN 47 007 371 333 ACN.
Client
The "client" is used interchangeably with "customer" and refers to the party for whom Canterbury Roof Tiles is performing work or providing goods and services. The client is responsible for payment, providing access to the work site, and communicating any issues or damage to Canterbury Roof Tiles for resolution.
Customer
The "customer" is the party entering into the agreement with Canterbury Roof Tiles as principal, not as an agent or servant of any other person. The customer is liable for all payments, fees, charges, or liabilities for work done by Canterbury Roof Tiles, regardless of whether they authorise another party to act on their behalf.
Manufacturer Warranty
Manufacturer warranties are provided by the producers of the roofing products (e.g., Monier, Bristile, LUTUM). These warranties cover defects in materials and may have specific terms, durations, and exclusions. Clients are referred to the relevant product-specific manufacturer warranties for further details. Copies of manufacturer warranties are available for inspection at any time. The benefits given by these warranties are in addition to other rights and remedies under law in relation to the products.
New Build
"New build" refers to roofing works performed on newly constructed buildings. In the context of payment terms, new builds require a deposit and staged payments as set out in the quotation or agreement. Site preparation requirements for new builds include ensuring the roof is ready for tiling, all carpentry and plumbing works are completed, and the site is properly prepared for the installation of tiles.
Payment
Payment terms vary by customer type and job:
- Account customers - 100% payable, 30 days after materials delivered to site or as agreed via progress claims.
- Reroof/ extensions/ New build : staged payments e.g. 10% deposit, 40% to be paid on day of delivery of materials and/or handrail installation, 30% on commencement of roofing works, 20% on completion.
- Repairs: For quotes under $800, payment is due in full at acceptance; for quotes over $800, 70% deposit upon acceptance and 30% balance on completion. All balances are payable within 30 days (account customers) or as otherwise agreed.
Quotation
A "quotation" or "quotation price" is the price provided by Canterbury Roof Tiles for the proposed work. The quotation remains open for acceptance for a specified period (typically 30 days) and once accepted, is fixed for a further period unless otherwise specified. The quotation may be varied if certain conditions change, such as delays, changes in site conditions, or alterations to the scope of work.
Repairs
"Repairs" refer to works undertaken to fix or restore existing roofing, as opposed to new installations or extensions. Payment terms for repairs typically require a higher deposit (e.g., 70% upon acceptance) with the balance due on completion. Repairs may include inspection, replacement of broken tiles, and other remedial works as specified in the quotation.
Title
Title to materials remains with Canterbury Roof Tiles until all sums due are fully paid. If payment is not made, Canterbury Roof Tiles may remove unpaid materials from the site. Outstanding balances may become a charge on the land or any receivable funds related to the work.
Warranty
Canterbury Roof Tiles provides a workmanship warranty (typically two years) on tile installation, valleys, sarking, and pointing. The warranty covers repairs or replacements at Canterbury’s discretion but excludes general wear and tear, non-compliance with manufacturer specifications, natural disasters, pest damage, stepping on tiles, or damage by third parties. The warranty is void if another company is engaged to fix or assess repairs assigned to Canterbury. Manufacturer warranties are separate and provided by the product manufacturers.
Work
"Work" refers to the scope of services provided by Canterbury Roof Tiles, including but not limited to: processing estimates, preparing job sheets, site inspection, delivery of materials, removal of old tiles (for re-roofing), installation of battens, tiling, bedding, pointing, and clean-up of re-roofing debris. The work is subject to the terms and conditions of the agreement.
